Trento, Oct. 3 (LaPresse) – LAV has been admitted as a civil party by the Trento Court in the trial involving a person under investigation for the killing of the bear F36 three years ago. Following the hearing, the judges recognized the animal rights association’s standing to participate in the proceedings, stating that “LAV is one of the main organizations dedicated to the protection of animals and the environment in Italy, whose interests were clearly harmed by the vile act of killing.” According to the association, “F36 was a shy bear that had never caused any problems for the people of Trentino, until, in the summer of 2023, she was awakened together with her cub by two hunters who had encountered her at close range. In response to the mother bear’s normal defensive reaction, the two hunters reacted in a completely counterproductive manner, fleeing, climbing, shouting and beating her with sticks, thereby provoking her behavioral response. Fortunately, F36 fled into the woods after a few seconds without any real consequences for the two people.” According to LAV, “this was enough for the president of the Province of Trento, Maurizio Fugatti, to label the bear as dangerous and then sentence her to death. We appealed to the administrative courts to save F36, engaging in a strenuous legal battle with the Province that went all the way to the Court of Cassation: the Italian judiciary confirmed not only that the bear was not dangerous, since her reaction had been caused by the reckless behavior of the two hunters, but also that her life enjoyed protection guaranteed by Article 9 of the Constitution.” But F36 was killed. “We opposed the request to dismiss the proceedings over her killing, providing all the necessary elements for the criminal proceedings to continue,” LAV stressed. “Now the association has been admitted as a civil party in the trial, so that it can provide technical and legal support to ensure that justice is finally done for the bear F36.”
