Rome, Oct. 29 (LaPresse) – All the judicial members of the CSM (with the exception of those belonging to Mi: Paola D’Ovidio, Eligio Paolini, Bernadette Nicotra, Maria Vittoria Marchianò, Luisa Mazzola and Edoardo Cilenti), together with lay members Ernesto Carbone, Michele Papa and Roberto Romboli, have called for the opening of a procedure to protect Tiziana Landoni, a preliminary investigations judge at the Milan Court, in connection with the Prime Minister’s statements regarding the decision not to validate the arrest of Youssef Siher. The statements are considered “unacceptable because they go beyond the bounds of legitimate criticism of judicial decisions, risking the delegitimization of the judge and the judicial function itself”. Judicial decisions “may be criticized, even harshly”, but “must not be portrayed as an obstacle to citizens’ security or as a belittling of the work of law enforcement”. “It is particularly worrying that such statements should come from the highest authority in Government – the council members write – with the risk of exposing the judge to unjustified personal delegitimization and turning unwelcome judicial decisions into occasions for political confrontation. The protection of public security and respect for constitutional safeguards are not opposing values, but essential components of the rule of law”. For this reason, they have requested the opening of a protection procedure “so that the Council may take the measures within its remit to safeguard the autonomy and independence of the judiciary and ensure that judicial duties can be carried out in a climate of serenity”.
