Milan, Oct. 28 (LaPresse) – The Brescia Prosecutor’s Office, which is investigating former Deputy Prosecutor of Pavia Mario Venditti, is accused by his lawyer, Domenico Aiello, of violating Article 58 of the Code of Criminal Procedure concerning the “availability of the judicial police.” Aiello, in a memorandum filed with the Milan General Prosecutor’s Office, requests the transfer of proceedings related to Venditti to Brescia, including the investigation into Andrea Sempio for the Garlasco murder and the probative hearing concerning the ongoing genetic and fingerprint consultancy in Pavia.
The lawyer argues that the law requires each Prosecutor’s Office to have its own judicial police section, and that the Brescia office is violating this rule by using not only the GICO unit of Brescia but also the Pavia Guardia di Finanza Group and the Milan Carabinieri Investigative Unit. The latter had been delegated by the Pavia Prosecutor’s Office to investigate Chiara Poggi’s murder and independently opened an inquiry in 2017 following a complaint by Alberto Stasi’s lawyer, Giada Bocellari.
In a statement released Sunday, Aiello called the charge against Sempio for Chiara Poggi’s murder, in complicity with Alberto Stasi, an “obvious ideological falsehood,” arguing that it conflicts with the Supreme Court ruling, which established that the victim was killed by a known person who arrived alone on a bicycle. Aiello also criticized the investigation into other possible accomplices of Stasi prior to the sentence review, emphasizing the obligation of every public official to respect res judicata.
