Rome, 23 July (LaPresse) – A hearing on the request for a discretionary deferral of sentence, pending the outcome of the application for a pardon submitted by Mario Roggero – the jeweller from Grinzane Cavour who was definitively sentenced to 14 years and 9 months for killing two robbers and wounding a third following a robbery at his shop – is due to take place on 16 September before the Milan Supervisory Court. The President of the Supervisory Court has scheduled the in-chamber hearing for 9.00 am at the Milan Palace of Justice. The proceedings concern the application provided for under Article 147(1) of the Criminal Code, which allows, in the event of a petition for a pardon, for the consideration of a discretionary deferral of the sentence’s enforcement. Roggero is currently detained at the Milan-Bollate Prison. The order stipulates that Roggero and his defence counsel, Mr Stefano Marcolini, may file any defence submissions up to five days before the hearing. The order also notes that the prisoner has the right to attend the hearing in person. Should he request this, arrangements have already been made for his transfer from prison to the courtroom. For prisoners held outside the district, there is also the option to participate via video link using the Teams platform, whilst for those detained within the Milan district, such as Roggero, physical attendance is deemed necessary. The hearing does not concern the merits of the conviction, which is now final, but exclusively the request to temporarily suspend the enforcement of the sentence pending a decision on the application for a pardon. It will be up to the Supervisory Court to assess whether the conditions laid down by law for granting the deferral are met.
