Naples, 15 Oct. (LaPresse) – The sum agreed as compensation between the Colli di Napoli Hospital Trust and the family of Domenico Caliendo, the two-year-old boy who died on 21 February following a failed heart transplant at the Monaldi Hospital in Naples, amounts to 960,000 euros. The settlement was reached following a claim for damages brought by the parents over their son’s death. Added to this sum are €41,625.80 in legal fees, bringing the total payout to over one million euros. The amount is set out in the resolution of 8 October signed by the Director-General of the Colli Hospital Trust (to which Monaldi belongs), Anna Iervolino, in which the hospital trust acknowledges the settlement agreement and orders the payment of the sums. The incident dates back to 23 December 2025, the date of the heart transplant undergone by little Domenico, which failed due to the condition of the heart harvested in Bolzano, which arrived in Naples by which time it was already unusable. The child died approximately two months later. The Naples Public Prosecutor’s Office is currently investigating the case, which involves seven doctors from Monaldi Hospital, who are under investigation for manslaughter (the head of department, Guido Oppido, and the senior nurse, Emma Bergonzoni, also face charges of forgery). The claim for compensation was lodged on 6 March by the parents. Following an initial attempt at settlement which proved unsuccessful, the hospital launched a preliminary investigation entrusted to the Claims Assessment Committee, comprising specialists in cardiac surgery, anaesthesia and forensic medicine, as well as legal advisers and experts in quantifying damages. On 31 July, a compensation offer of 960,000 euros was made, which was accepted on 6 August by the family’s lawyer, Francesco Petruzzi. The settlement covers a total of six members of the child’s family. In its resolution, the Colli Hospital Trust specifies that the settlement constitutes a resolution of the compensation dispute and does not constitute an acknowledgement or determination of the personal liability of the individual healthcare professionals involved. Furthermore, recourse actions against any jointly liable parties remain possible. The documentation will be forwarded to the Regional Prosecutor’s Office of the Court of Auditors for the relevant assessments. The compensation agreement does not affect the criminal proceedings, which are continuing separately.
