Milan, 27 Oct. (LaPresse) – “We have requested that the application for precautionary measures be rejected and that the arrest not be validated.” This was stated by lawyer Benedetto Ciccarone, who, together with his colleague Yasmina Abu Sharar, is defending Youssef Siher, as he left the San Vittore prison in Milan following the validation hearing before investigating magistrate Tiziana Landoni. Siher, administrator of the social media groups for the ‘17 October Movement’ – formed following the weekend’s clashes in Milan – is accused of incitement to commit a criminal offence, aggravated by the aim of terrorism and organised violence at public demonstrations. Before the judge, he exercised his right to remain silent. “It is his choice; it is a right, and he has exercised it,” explained Abu Sharar. According to his lawyer, Siher was not distressed: “He was certain that he had exercised his constitutionally guaranteed freedoms and rights.” Ciccarone maintains there is no risk of him absconding and “there is neither serious evidence of guilt nor grounds for pre-trial detention, which is why we have contested both aspects”. The defence has also contested the aggravating circumstance of terrorism and the very existence of the offences. “In my view, they are not acts of incitement. Those are not offences,” added the lawyer. Regarding the offence of organised violence at demonstrations, which came into force on the 23rd, Ciccarone clarified that “the charges are limited to those days”. According to the defence lawyers, Siher is well and calm. “We are not surprised in absolute terms, given the current political climate, but in this specific case, yes. He has not committed any offence,” emphasised Ciccarone. The defence team is also representing Siher’s wife, who is under investigation but not in custody, and who, according to Abu Sharar, “is certainly not happy”. As for why the detention order was issued only for her husband, the lawyer referred the matter to the magistrates who made the decision. Milan, 27 Oct.
