Almasri case, majority report: ‘Serious procedural flaws by the Ministers’ Tribunal’

Rome, 8 October (LaPresse) – ‘The violations committed by the Ministers’ Tribunal of Rome are so serious and numerous that it is unnecessary to examine the merits of the case.’ This is the argument put forward in the defence brief sent on 15 September to the Authorisation Committee of the Chamber of Deputies by the government officials under investigation in the Almasri case, namely the Ministers of Justice and the Interior, Carlo Nordio and Matteo Piantedosi, and the Undersecretary, Alfredo Mantovano. The defence brief highlights “serious procedural flaws that would have invalidated the activities of the Ministers” Tribunal. These violations, which in ordinary proceedings would render the acts null and void, would deprive the authorisation request itself of legal value, to be considered tamquam non esset’ (as if it did not exist).
