(LaPresse) – On the Almasri case: “We forwarded the case files to the Roman judiciary the other day because the Constitutional Court had declared the 2012 law – which had allowed us to detain them – to be unconstitutional. We need to be clear on this, because I have heard many inappropriate comments, such as the suggestion that the Court had ‘taken us to task’. Instead, the Court, as is its duty, has, so to speak, ‘taken the law to task’. We applied the law in force at the time, which granted the Ministry a degree of discretion regarding the forwarding of the documents. The Court declared it unlawful insofar as it did not require their immediate forwarding. This is known as an ‘additive’ ruling. Under the law at the time, we could have avoided forwarding them immediately.” So said Justice Minister Carlo Nordio in an interview with *Il Giornale*.
