Experience teaches us that, as a precautionary measure, the response must be absolutely rigorous. It pains me to say it, but prison is necessary. The strictest pre-trial detention is required, because restraining orders and reporting requirements systematically prove to be inadequate. The laws are there, but they need to be enforced.” Giulia Bongiorno – chair of the Senate Justice Committee and the lawyer who drafted and signed the ‘Codice Rosso’ law – told LaPresse this whilst commenting on the release of the 42-year-old man arrested in Turin for molesting a 13-year-old girl in a convenience shop. The judge released him, ordering him to sign in regularly whilst awaiting trial. “I don’t know what the judge was thinking, but these incidents are not isolated, and I cannot stress this enough. It’s typical: there are multiple instances of such behaviour. In fact, there is often an escalation. So, when there is a chance to identify one of these offences, in my view, stricter measures need to be applied, because experience shows that without imprisonment, the offences are repeated. I’m sorry,” she reiterates, “but imprisonment is necessary.”
