Rome, June 9 (LaPresse) – Concern over the “frequent use of emergency decree legislation” was expressed by Constitutional Court President Giovanni Amoroso, who at the “Rule of Law” seminar recalled how the Court’s case law has established “a very clear safeguard” regarding the requirement of consistency among provisions contained in decree-laws. “Leges and iura have distinct and separate actors: the legislator, who enacts the rules, and the judge, who brings them to life within the legal system,” Amoroso added. “Although the Italian Constitution does not contain an explicit reference to the rule of law, it embodies a balanced model of a state governed by law” founded on constitutional democracy. Amoroso reiterated the “central role of the Constitutional Court in safeguarding the rule of law”, highlighting that “the rigidity of the Constitution serves as a guarantee of constitutionally protected rights”, and recalled the existence of supreme principles that cannot be amended even through constitutional revision.
