(LaPresse) – “Belgium may initiate a transfer procedure to another Member State when, on the basis of the criteria set out in the Regulation, that Member State is identified as responsible for examining an application for international protection.” This was stated to LaPresse by Dominique Ernould, spokesperson for the Belgian Federal Public Service for Internal Affairs (IBZ), when asked about the handling of so-called ‘Dublin cases’ and transfers to Italy. “From 12 June 2026, Belgium will apply the new rules of the European Pact on Migration and Asylum, including the Regulation on the Management of Asylum and Migration (AMMR). Under the new rules, when another EU country is deemed responsible for an application for international protection, the Belgian authorities may initiate the procedure for transfer to that State,” emphasised Ernould, adding that “the transitional provisions stipulate, however, that applications registered before 12 June will continue to be governed by the previous Dublin rules, whilst for those registered from that date onwards, the new framework set out in the EU Pact applies”. “Belgium continues to apply these rules on a case-by-case basis, in accordance with the European legal framework and the prescribed procedures,” the spokesperson clarified.
